If a tree is damaged or destroyed by a neighbor, it is the responsibility of the person causing the damage, conceivably in dollar damages,&#8221; he says.<\/p>    <p class=\"wp-block-paragraph\">Those dollars add up: Harm a tree and you can be liable for up to three times its <a href=\"https:\/\/www.findlaw.com\/realestate\/neighbors\/conflicts-involving-trees-and-neighbors.html\" target=\"_blank\" rel=\"noreferrer noopener\">tree replacement value<\/a>, and most trees are worth thousands of dollars.<\/p>    <p class=\"wp-block-paragraph\"><strong>Other tree maintenance:<\/strong> The tree doesn&#8217;t have to be chopped down to cause a legal battle. Whether you decide to trim branches, cut tree roots, or treat parts of the tree with a chemical that ultimately damages that tree or your neighbor&#8217;s trees, you could be liable for damages.<\/p>    <h3 id=\"5-cutting-roots-and-overhanging-branches\" class=\"wp-block-heading\">Cutting Roots and Overhanging Branches<\/h3>    <p class=\"wp-block-paragraph\">What can you do about overhanging branches or roots that damage sewer lines or leaves that clog gutters? What about a tree with broken limbs or cracked trunks?<\/p>    <p class=\"wp-block-paragraph\">If it&#8217;s a dangerous tree, you have the right to trim branches and <a href=\"https:\/\/www.lawnstarter.com\/blog\/tree-care\/tree-root-removal-how-to-guide\/\">cut and remove tree roots<\/a> that intrude into pipes or foundations within your real estate. This includes a tree whose trunk is entirely on a neighboring property. Here is how to handle it:<\/p>    <h3 id=\"8-what-to-do-about-a-dangerous-tree\" class=\"wp-block-heading\">What to Do About a Dangerous Tree<\/h3>    <p class=\"wp-block-paragraph\">A dead limb or leaning tree next door can put your home and family at risk, and you have options short of a lawsuit. Start by telling your neighbor about the hazard in writing, and keep a copy for your records.<\/p>    <p class=\"wp-block-paragraph\">If they ignore a clear danger, report the tree to your city or local code enforcement, since many towns require owners to remove hazardous trees on private property. It&#8217;s not your responsibility, since it was caused by Mother Nature. Your neighbor will have to file an insurance claim.<\/p>    <p class=\"wp-block-paragraph\"><strong>The exception:<\/strong> Let&#8217;s say the branch has been dead for years. Your neighbor has complained and asked you to cut it down, but you failed to do so.
